About Candidates Inc. provides various virtual headhunting services. The Services include Guaranteed Hires.

In advance of the commencement ofany positions to be filled, position descriptions will be provided to us. In the case that you do not have exiting position descriptions, we can assist with this process. This document describes your organization, the role itself and the required position qualifications. In addition, it is a key communication tool which summarizes our understanding of your requirements. It is also the information we use to design our Marketing Page which showcases your firm and  the position.

Our research phase includes conducting original research to identify potential candidates.

During the next phase, we conduct in-depth interviews with each of the most promising candidates. This phase focuses on generating a short list of qualified and interested candidates for your review and hire.

The fixed, flat rate fees do not include a guarantee policy that the hired associate will not voluntarily leave or be discharged.

However, if the candidate About Candidates Inc. placed is terminated for cause or if the person voluntarily quits (organizational realignment, restructuring, event of death or long term illness not applicable) and ceases to be employed by you in any capacity within 90 days of his/her commencement of employment, we will search for a replacement to fill the original position for no additional cost, provided there is no material change to the original position description.

Fees

(a) In consideration for the services of AC, AC shall be paid a “fee for services”(“FFS”).

(b) The fixed, flat rate fees are based on CLIENT sign off on all documents that will be prepared at the beginning of every new service to clearly outline the parameters of the service.

Our fees are payable in two stages during the recruiting process:

  • One-half payable at the beginning of the process.
  • The final half per position payable upon conclusion of each assignment

An assignment may be cancelled at any time.  However, our minimum fee will be the first instalment billing, plus the accrued billing to the day of the assignment’s cancellation, based on a 90-day term.  If the assignment is cancelled after 90 days from the commencement of the search, the final portion is payable in full.

Any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than [our manufacturer/supplier(s) and] if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

Your information is used in support of the Services and products offered. Your personal information and e-mail address is never used for unsolicited mail or purpose.

Disclaimer; Exclusions and Limitations

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

Except where prohibited by applicable law, any claim, dispute or controversy (whether in contract or tort, pursuant to statute or regulation, or otherwise, and whether preexisting, present or future) will be referred to and determined by a sole arbitrator (to the exclusion of the courts).  Except where prohibited by applicable law, you waive any right you may have to commence or participate in any class action against About Candidates Inc. related to any Claim and, where applicable, you also agree to opt out of any class proceedings against About Candidates Inc. If you have a Claim, you should give written notice to arbitrate at the address specified below.  If we have a Claim, we will give you notice to arbitrate at your address provided in your Registration Data.  Arbitration will be conducted by one arbitrator pursuant to the commercial arbitration laws and rules in effect on the date of the notice in the Province of Ontario.

To the extent arbitration as described in the immediately preceding paragraph is prohibited by applicable law, you agree that all Claims will be heard and resolved in a court of competent subject matter jurisdiction located in Toronto, Ontario. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts.

Do not access or use our Site where the foregoing is prohibited by applicable laws in the jurisdiction where you reside or from where you are accessing the Site. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply.

About Candidates Inc. may assign any or all of its rights hereunder to any party without your consent.  You are not permitted to assign any of your rights or obligations hereunder without the prior written consent of About Candidates Inc., and any such attempted assignment will be void and unenforceable. These Terms constitute the entire agreement between you and About Candidates Inc. regarding your use of the Site, and supersede all prior or contemporaneous communications whether electronic, oral or written between you and About Candidates Inc. regarding your use of the Site. The parties confirm that it is their wish that these Terms, as well as any other documents relating to this Terms, including notices, have been and shall be drawn up in the English language only. The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change.
